Terms of Service

These Terms of Service ("Terms") govern your use of the bos mobile application and the bethebos.ai website (collectively, the "Service") operated by Book of Spells ("bos," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

2. Account Registration

To use the Service, you must create an account by providing a valid email address, password, display name, username, and phone number. You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized use of your account
Ensuring your account information is accurate and current

Usernames must be 3–20 characters and may only contain lowercase letters, numbers, dots, and underscores. We reserve the right to reclaim or reassign usernames at our discretion.

3. Description of Service

bos is a voice-first AI life assistant. The Service allows you to:

Create and manage items (reminders, notes, events, lists, timers) using voice commands or manual input
Ask questions and receive AI-generated answers
Send and receive messages with other bos users
Use Portals for walkie-talkie-style voice communication with friends
Sync items with Apple Calendar
Receive push notifications for reminders and messages

The Service relies on AI technology to interpret voice commands and generate responses. AI-generated content may not always be accurate, complete, or appropriate. You acknowledge that AI outputs are provided on an "as-is" basis and should not be relied upon for critical, medical, legal, or financial decisions.

4. Subscriptions and Payment

4.1 Free Trial

New users receive a free trial period with full access to all features and 100 AI requests per day. The trial duration is specified at the time of registration. When your trial expires, your account will transition to the free tier unless you subscribe to a paid plan.

4.2 Subscription Plans

Paid subscriptions are available as monthly ($4.99/month) or annual ($39.99/year) plans, providing 100 AI requests per day, unlimited portals, voice messaging, and access to all features. Prices may change with notice. Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions for in-app purchases.

4.3 Free Tier

After your trial expires, the free tier provides limited access: 5 AI requests per day, no AI-initiated features, read-and-respond messaging only, and a maximum of 3 portals.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through Apple's subscription management in your device's Settings > Apple ID > Subscriptions. Upon cancellation, your subscription remains active until the end of the current billing period. Refunds are handled by Apple in accordance with their refund policies.

5. Acceptable Use

You agree not to use the Service to:

Violate any applicable law, regulation, or third-party rights
Send harassing, threatening, defamatory, obscene, or otherwise objectionable content
Impersonate another person or entity
Attempt to gain unauthorized access to other users' accounts or our systems
Interfere with, disrupt, or place an undue burden on the Service or its infrastructure
Use automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable usage
Circumvent or attempt to circumvent rate limits, subscription restrictions, or other usage controls
Use the Service to generate, store, or distribute spam, malware, or illegal content
Reverse-engineer, decompile, or disassemble any part of the Service
Use AI-generated responses to cause harm, spread misinformation, or for any illegal purpose

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

6. Voice Data and AI Processing

By using the speak feature, you consent to your voice being recorded, transcribed, and processed by AI systems to fulfill your requests. Speech-to-text conversion occurs on your device. Text transcripts are sent to our servers for intent processing, which may involve third-party AI providers (Anthropic Claude API).

You acknowledge that AI interpretation may occasionally misunderstand your intent. You are responsible for reviewing and verifying the items created on your behalf. The Service provides undo and edit capabilities for this purpose.

7. User Content

You retain ownership of all content you create or upload through the Service ("User Content"), including items, messages, voice recordings, and shared items.

By using the Service, you grant us a limited, non-exclusive, worldwide license to store, process, transmit, and display your User Content solely as necessary to provide and improve the Service. This license terminates when you delete your content or your account.

You are solely responsible for your User Content. You represent that you have the right to share any content you upload or transmit through the Service.

8. Portal Voice Messages

Portals enable asynchronous voice communication between users. By using Portals, you acknowledge and agree that:

Voice recordings are sent to and stored on our servers for delivery to the recipient
Portal messages are limited to 10 seconds in duration
Portals enforce back-and-forth communication — you cannot send consecutive messages without a reply
Recipients receive push notifications when portal messages arrive
You will not record or share confidential information of others without their consent

9. Intellectual Property

The Service, including its design, code, features, branding, the "bos" name, and the "Book of Spells" name, are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code.

The bos app icon, wordmark, theme designs, and visual identity are our proprietary assets. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

10. Third-Party Services

The Service integrates with third-party services including Apple's App Store, Apple Speech Recognition, Apple WeatherKit, Apple EventKit, Apple Push Notification service, Anthropic Claude API, and RevenueCat. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

11. Disclaimers

Important — please read carefully

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free
AI-generated responses will be accurate, complete, or reliable
Results obtained from the Service will meet your requirements
Any errors in the Service will be corrected

You use the Service at your own risk. We are not responsible for any missed reminders, incorrect AI interpretations, failed message deliveries, or other service interruptions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOOK OF SPELLS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party on the Service
Unauthorized access, use, or alteration of your content
AI-generated content that is inaccurate, incomplete, or inappropriate
Missed reminders, notifications, or scheduled events

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless Book of Spells and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any rights of a third party, or (d) your User Content.

14. Termination

You may terminate your account at any time by using the Delete Account feature in the app's Settings, or by contacting us at support@bethebos.ai.

We may suspend or terminate your account and access to the Service at any time, with or without cause, including but not limited to violations of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) shall survive.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in the English language. The arbitrator's decision shall be final and binding.

You agree that any dispute resolution will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Effective Date" and, where appropriate, through in-app notification. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

If you do not agree to the revised Terms, you must stop using the Service and delete your account.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Book of Spells regarding the Service and supersede all prior agreements, representations, and understandings.
